End User License Agreement (Jan 26, 2026)
1. Introduction
This End User License Agreement (hereinafter the “Agreement”) is entered into between you and Pebble Stream UAB (“Company”, “Pebble Stream”, “we”, “us”), and sets forth the rights and obligations regarding the use of the Pebble Stream Launcher software (hereinafter the “Software”). By installing, copying, or using the Software, you are deemed to have agreed to the terms of this Agreement. Pebble Stream may cooperate with third-party service providers in the development and operation of the Launcher Software. Matters related to the collection, use, storage, and processing of personal information, service availability regions, governing law, dispute resolution, and jurisdiction regarding the use of this Launcher Software are governed by Pebble Stream’s Terms of Service and Privacy Policy. - Pebble Stream Terms of Service: https://www.pebblestream.io/terms - Pebble Stream Privacy Policy: https://www.pebblestream.io/privacy By agreeing to this Agreement, you also agree to be bound by Pebble Stream’s Terms of Service and Privacy Policy.
2. Definitions
- “Software” means the launcher program provided by Pebble Stream. - “User” means an individual or entity that installs or uses the Software. - “License” means the right to use the Software in accordance with this Agreement.
3. Grant of License
Pebble Stream grants you a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to use the Software for personal and non-commercial purposes. For the purposes of this Agreement, “non-commercial use” means use for personal entertainment, education, or research. Unless otherwise agreed in writing, this does not include any commercial redistribution, rental, or provision in public venues (e.g., internet cafés, gaming centers, paid streaming services, etc.). The Software is licensed, not sold, and this Agreement does not transfer any ownership rights in the Software to you. Access to and use of the Software are governed solely by this Agreement.
4. License Restrictions
You may not engage in any of the following acts: 1) Reverse engineering, decompiling, disassembling, or modifying the Software. 2) Copying, selling, leasing, renting, distributing, or sublicensing the Software or any part thereof without authorization. 3) Removing, circumventing, or altering copyright notices, security, or update technologies contained in the Software. 4) Creating, distributing, or using unauthorized programs such as automation tools, cheats, or hacking tools, or otherwise interfering with the normal operation of the Software or support services. 5) Interfering with another user’s use of the Software or Pebble Stream’s service operations. 6) Accessing, emulating, or redirecting unauthorized servers, networks, or data. 7) Deleting or altering trademarks, logos, copyrights, or other proprietary notices, legends, symbols, or labels contained in the Software.
5. Ownership
All rights, title, and intellectual property rights in and to the Software are owned by Pebble Stream or its licensors. This Agreement does not transfer any rights or ownership to you.
6. Updates and Patches
1) Provision of Updates Pebble Stream may provide patches, updates, or upgrades to the Software as necessary for security, stability, functionality, or compliance with legal or contractual obligations. Such updates may be installed automatically or manually, with or without prior notice, and you consent to such updates. 2) Service Modification or Discontinuation Pebble Stream may modify, suspend, discontinue, replace, or restrict access to all or part of the Software or services. In such cases, Pebble Stream will provide prior notice within a reasonable period on the Pebble Stream website (https://www.pebblestream.io). Since the Launcher service is currently provided free of charge, no monetary or other compensation will be provided in connection with any modification or discontinuation. However, if paid services are introduced in the future, Pebble Stream will comply with applicable legal requirements for refunds or remedies. 3) Purpose of Installation Updates and patches are carried out to maintain or improve the functionality of the Launcher, respond to platform changes, or ensure the proper operation of games installed, executed, or updated through the Launcher. 4) System Requirement Changes System requirements necessary for running the Software or using games may change after applying updates or upgrades. You are responsible for taking necessary measures to meet such requirements. 5) Uninstallation Method You may remove the Launcher via the “Add/Remove Programs” menu in the Control Panel or through the uninstallation program included with the Software. 6) No Obligation for Maintenance or Support Pebble Stream has no obligation to provide maintenance or technical support in relation to the Software or services. However, at Pebble Stream’s discretion, updates, patches, or technical support may be provided, subject to limitations in scope and duration. Pebble Stream does not guarantee future availability of the Software or updates and assumes no responsibility for any discontinuation or removal.
7. Warranty Disclaimer and Limitation of Liability
1) Disclaimer of Warranties The Software is provided “as is”, “as available”, and “with all faults”, without any warranties of any kind. Pebble Stream expressly disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. 2) Limitation of Liability To the maximum extent permitted by law, Pebble Stream shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the Software. In no event shall Pebble Stream’s total liability exceed the amount actually paid by you for the use of the Software, if any. 3) Exclusions from Liability Pebble Stream shall not be liable for issues unrelated to the provision of the Launcher, including but not limited to your device environment (hardware, operating system, drivers, etc.), third-party games and services, payment methods, your negligence or breach of this Agreement, or force majeure (natural disasters, war, legal changes, government regulations, network failures, etc.).
8. Modification and Termination of Agreement
Pebble Stream may amend this Agreement for operational, legal, or technical reasons. In such cases, Pebble Stream will provide prior notice of the changes within a reasonable period on the Pebble Stream website (https://www.pebblestream.io). The amended Agreement will take effect on the announced effective date. By continuing to download, install, update, or use the Launcher or games installed through the Launcher after the effective date, you are deemed to have agreed to the amended Agreement. If you breach the terms of this Agreement, it will terminate automatically without prior notice. Upon termination, you must immediately cease using the Software and delete all copies in your possession or control. Termination of the license shall not limit Pebble Stream’s other rights or remedies available under law or equity. Provisions of this Agreement that by their nature should survive termination (e.g., ownership, updates and patches, warranty disclaimer and limitation of liability) shall remain in effect even after termination.
9. Relationship with Games
The Launcher is a tool that allows you to download, install, update, and run games. All rights and responsibilities regarding the content, features, accounts, payments, data progression, service quality, and operation of such games rest with the respective game providers. Pebble Stream makes no warranties or assumes any responsibility regarding the games themselves. Pebble Stream also disclaims any warranties or responsibility for third-party services and content that are installed, executed, or updated through the Software. When using games or third-party services, you must comply with the terms and policies of the respective providers.
